[Natural Gas Boiler Guarantee]
Buderus is a trading name of Bosch Thermotechnology Ltd.STATUTORY RIGHTS OF THE OWNER ARE NOT AFFECTED BY THE GUARANTEE
1. Bosch Thermotechnology Ltd. hereby guarantees the following (the "Guarantees"):-
(a) That the Boiler will be free from defective parts or workmanship for a period of twelve months from the date of installation providing the boiler has been commissioned immediately after installation and in accordance with the relevant installation instructions.
(b) This period shall be increased to 24 months when the completed registration form is returned to Bosch Thermotechnology Ltd. within eight weeks of installation & commissioning and in accordance with the relevant installation instructions.
(c) This additional guarantee is subject to the conditions detailed in section 2(c). This guarantee does not extend to secondary heat exchangers or secondary thermal stores, which are covered by the guarantee as detailed in section 1(a) and if applicable 1(b).
(d) The Installation and Commissioning must be carried out by a competent engineer experienced with Gas-fired appliances (i.e. a CORGI registered engineer) and reasonable proof that the commissioning has been completed must be supplied upon request. (Benchmark Logbook)
2. The Guarantees are subject to the following conditions:-
(a) All claims under the Guarantees are subject to examination by Bosch Thermotechnology Ltd. Any costs incurred by Bosch Thermotechnology Ltd. in ascertaining that any claim for defects are not valid shall be borne by the owner.
(b) The Guarantees detailed in section 1(a) and 1(b) extend to reasonable labour costs. These costs must be authorised by Bosch Thermotechnology Ltd. prior to the works being carried out.
(c) The Guarantee detailed in section 1(c) is subject to the following conditions:
(i) The Heat Exchanger and the system to which the boiler is connected is free from contamination which will be proved by means of a water sample analysis test report and by internal examination of the Heat Exchanger.
(ii) The Heat Exchanger must be returned to Bosch Thermotechnology Ltd. for an internal examination.
(iii) Where contamination or system fault is found to be the cause of failure, Bosch Thermotechnology Ltd. shall not be liable under the guarantee, nor responsible for any other costs incurred.
(iv) The owner will be liable for all materials and labour charges in the first instance. Bosch Thermotechnology Ltd. will reimburse all reasonable costs relating to the replacement of the Heat Exchanger where the claim is deemed to be valid.
(v) Where a valid claim is made, reasonable labour costs shall not exceed £200.
(d) Bosch Thermotechnology Ltd. must receive all claims under the Guarantee within the above mentioned time limits.
(e) The Boiler must be installed in accordance with the installation instructions and good practise, and COMMISSIONED, using recognised test equipment, before handover to the owner, as detailed in the Boiler manual.
(f) Regular maintenance at intervals recommended by Bosch Thermotechnology Ltd. must be carried out.
(g) Bosch Thermotechnology Ltd. shall be under no liability in respect of any defect arising from negligent installation, fair wear and tear or for damage, negligence, abnormal environmental conditions, failure to follow instructions, misuse, alteration, tampering or repairing by unqualified persons.
(h) If the owner is to arrange for an engineer to examine or repair the Boiler, prior authorisation must be obtained from Bosch Thermotechnology Ltd. The attendance by a Bosch Thermotechnology Ltd. Registered Engineer is deemed to meet this condition.
(i) In relation to any valid claim under clause 1, if the boiler was installed more than 6 months from the date of dispatch from Bosch Thermotechnology Ltd., then the guarantee period shall be deemed to have commenced six months from the date of despatch from Bosch Thermotechnology Ltd.
(j) The Guarantees do not extend to replacement parts which are not specified by Bosch Thermotechnology Ltd.
3. If any valid claim is made by the owner under any or all of the Guarantees, Bosch Thermotechnology Ltd. or their registered engineer shall (if considered applicable) repair or replace the defective boiler (or any defective part thereof), provided always that any such defective part is returned to Bosch Thermotechnology Ltd.
4. The Guarantees do not extend to any consequential loss or damage.
5. These Guarantees apply only to the UK, Channel Isles and Isle of Man.
